Industrial manslaughter provisions are in effect in Queensland and ACT Workplace Health and Safety Legislation. There has been a concerted push to nationalise these legal provisions. A revised Industrial Manslaughter bill was lodged in NSW parliament in April 2018. Should either proposal proceed, the implications for business leaders in NSW may be significant.

To help you and your organisation prepare for the changes, Lloyd's Register is hosting a breakfast presentation to provide you with insights on:

  • The case for change – Background, incidents, and precedents. 
  • Industrial manslaughter provisions – Summary of provisions in Queensland and ACT. Comparison between Industrial Manslaughter and Workplace Death.
  • Implications of change – Changes to the regulatory approach, changes to investigations, focus on persons, and increase in prosecutions.
  • Practical mitigations – Focus on integrated management systems. Establishment of safety culture and engagement with the workforce. Maintenance of a risk management approach and an operational focus. Training, competence, and supervision. 
  • Practical response to workplace incidents and injuries.  
  • Assurance & certification to check and prove the robustness of the system.
