On 15 December 2019, amendments to the Building and Construction Industry Security of Payment Act took effect with key changes to how contractor payment claims will be adjudicated. The changes widened the scope of contracts covered, clarified the potential end-date for commencing claims, potentially excludes claims for backcharges, liquidated damages and prolongation claims for loss and expense unless satisfying certain conditions, codified adjudication Court decisions into the amendments for when claims are to be served and adjusted the review process for adjudication determinations.

The key questions now for the construction industry could be deciding when and how claims and payment responses can be made to come within the Act and more importantly how contractor cash-flow may be affected. Daniel Tay, lawyer and partner at Chan Neo LLP, will provide a practical legal perspective on recent adjudication cases before the Singapore Courts, how subsequent claims may be determined by an adjudicator, the potential impact of changes in the Act on affected parties in a project payment cycle and the possible evolution of construction contract terms.
