About this event

This session aims to provide participants an insight as to how various jurisdictions globally have treated the Privy Council's decisions in Sian Participation Corp (in liquidation) v Halimeda International Ltd [2024] UKPC 16 and in FamilyMart China Holding Co Ltd v Ting Chuan (Cayman Islands) Holding Corporation [2023] UKPC 33, in particular the standard to be applied when seeking to stay or dismiss winding up petitions (both on insolvency and on just and equitable grounds) where the resolution of disputes in the underlying contract are subject to an arbitration clause between the parties. The webinar will cover recent jurisdictional developments in (i) the BVI; (ii) the Cayman Islands; (iii) Bermuda; (iv) Singapore; (v) England and Wales; (vi) Hong Kong; and (vii) Thailand.

Amelia Tan, Counsel, Carey Olsen

Amelia is counsel in leading offshore law firm Carey Olsen's litigation, insolvency and restructuring practice in Singapore, specialising in Bermuda, British Virgin Islands and Cayman Islands laws. She has a broad range of experience in commercial litigation, with a focus on complex, multi-jurisdictional shareholder / director litigation, corporate disputes, fraud and asset tracing and cross-border insolvency and restructuring matters. Amelia also has significant experience in advising listed companies and financial institutions, high net worth individuals and insolvency practitioners in the region, and has represented clients in the High Court, Court of Appeal and the Privy Council including in cases involving novel points of law.

Amelia has been listed as a Leading Associate (previously Rising Star) consecutively by The Legal 500 Asia Pacific in 2023, 2024 and 2025. She has also been named in the Asian Legal Business (ALB) Offshore Client Choice List in 2024 and 2025. Amelia is one of the five global finalists (and only recipient in Asia) of the IWIRC Rising Star Award in 2022 and is also part of the International Insolvency Institute's (III) highly prestigious and successful NextGen Leadership Program Class XII (2023). She is admitted as a solicitor of the Eastern Caribbean Supreme Court (BVI) and is enrolled as a Registered Associate in the Supreme Court of Bermuda. She is also admitted as an advocate and solicitor of the Supreme Court of Singapore (non-practising) and as a solicitor of the Senior Courts of England and Wales (non-practising).

Jonathan Tang, Director, Prolegis LLC

Jonathan is a Director in Prolegis LLC and the Head of Restructuring, Turnaround & Insolvency for the Herbert Smith Freehills Prolegis Formal Law Alliance. He is qualified to practice in Singapore.

Jonathan's practice focuses primarily on restructuring, corporate insolvency, and workouts. Jonathan regularly advises and represents insolvency professionals, companies, and creditors in judicial management, scheme of arrangement, and winding up proceedings before the Singapore High Court. Deals that he has worked on include as debtors' counsel in the restructuring of the Zipmex group of companies, which was shortlisted for the Restructuring Deal of the Year at the IFLR Asia-Pacific Awards 2023 and was recognised as an impact deal / case of the year at the Asialaw Awards 2024.

Jonathan is recognised as a "rising star" in the Singapore restructuring and insolvency space. He is ranked in the Up and Coming category in Chambers Asia Pacific 2024. The Prolegis LLC restructuring and insolvency practice which he heads has recently been recognised as one of the practices to watch in the domestic restructuring and insolvency space by the Legal500 directories.
