★ABOUT THIS ONLINE TALK

Resignations are not always as straightforward as they appear. In today’s workplace, management decisions such as restructuring, transfers, demotions or remuneration adjustments can be perceived as pressure tactics that “push” an employee to leave.

Under Malaysian employment law, a resignation given under such circumstances may be challenged in the Industrial Court. This may result in reputational risk, and significant back-wages or compensation.

This session is designed for employers, business owners, HR leaders, and managers. We will break down how indirect dismissal claims arise, what the Industrial Court looks for, and the common “red-flag” scenarios that turn ordinary HR actions into litigation. Most importantly, the talk will provide practical steps for managing sensitive exits and organisational change confidently while minimising legal exposure.

★SPEAKERS

Carolyn Ng graduated with a Bachelor of Laws First Class Honours from the University of the West of England in 2019 and completed her Bar Professional Training Course (BPTC) in 2020 and was admitted as a member of the Honourable Society of Lincoln’s Inn. She commenced her pupillage in MahWengKwai & Associates under the guidance of Ms Lesley Lim.

Carolyn completed her pupillage in October 2021 and was admitted as an Advocate and Solicitor of the High Court of Malaya in March 2022. Carolyn’s areas of practice include general litigation, strata management, employment law and intellectual property.

Elissanur Suraya graduated with First Class Honours in Bachelor of Laws from the National University of Malaysia in 2023. She then commenced her pupillage in MahWengKwai & Associates under the guidance of Mr Gan Chong Chieh.

During her pupillage, Elissanur gained exposure to various practice areas, including medical negligence claims, personal injury claims, employment law, commercial litigation, syariah advisory, will drafting and land disputes.

Upon completion of her pupillage, Elissanur was admitted as an Advocate and Solicitor of the High Court of Malaya on 6 September 2024 and began practice as an Associate at MahWengKwai & Associates upon her admission. Elissanur’s areas of practice include medical law, personal injury cases, employment law, etc.
