Description

The Construction Industry Payment and Adjudication Act 2012 (CIPAA 2012) has taken the industry by storm. Recent statistics produced by AIAC show that there have been close to 1000 adjudication applications since the inception of CIPAA 2012. This trend will continue as parties in the industry are making use of the adjudication process provided under CIPAA 2012 to resolve payment disputes swiftly and cost effectively. In this one day workshop, we focus on the adjudication process under CIPAA 2012, particularly on how to prepare effective adjudication claims, responses and replies.

This workshop will cover:

Our speaker:

Sr Dr Muhammad Ehsan Che Munaaim is a Senior Consultant with HKA Global, based in Dubai, UAE. He has over 13 years of experience in contract management and administration, claim management and dispute resolution. Ehsan has provided claims and dispute resolution consulting services to employers and contractors in Afghanistan, India, Iraq, Kingdom of Saudi Arabia, Malaysia, Qatar, Tanzania and the UAE on projects valued at up to US$10 billion across various sectors including residential, commercial, education, oil and gas, petrochemical, power generation, railway and aviation. Ehsan has worked with various procurement and contracting routes including traditional, D&B and EPC under bespoke forms of contract and standard forms such as FIDIC. He has delivered 10 seminars and run two workshops on construction claims and dispute resolution in the UAE and Malaysia. He has also presented 20 research papers on adjudication at conferences in the UK, Australia, South Africa, Singapore and Malaysia and has published six papers on the same subject in leading journals including the Construction Law Journal. Ehsan has taught over 1500 undergraduate and postgraduate students at four universities in the UK, UAE and Malaysia, including University College London. Ehsan’s PhD research at King’s College London developed a framework for the effective operation of a statutory adjudication regime in common law jurisdictions and was supervised by Professors Phillip Capper and Nicholas Gould and examined by Professors John Uff and Doug Jones. He is also on the Advisory Panel of the Adjudication Research + Reporting Unit at the University of New South Wales, Australia as well as a panel adjudicator with AIAC.
